NYSDEC issued a Notice of Violation to Town Supervisor Carl Fulgenzi regarding the Mount Pleasant Lozza Drive Material Storage and Processing Yard at 125 Lozza Drive. Included here as a related matter.
Background
Department staff conducted a site visit on July 10, 2026.
Violations cited
- 6 NYCRR Part 360.9(a)(1)(2): Construction and demolition (C&D) debris was observed spread over the top surface of the yard — considered disposal of the waste via landfilling under the regulation, without the required registration or permit.
- 6 NYCRR Part 360.19(b)(2) (Water Protection): Staff observed a dewatering pit with standing water and leachate, with an outlet on the north side of the site, without a State Pollutant Discharge Elimination System (SPDES) permit covering that discharge.
Corrective action
The notice states NYSDEC is aware the Town is “actively working to correct the violations” and will consider corrective actions taken when determining enforcement. The notice is explicit that correction doesn’t waive the Department’s right to seek penalties.
